Shipping Policy

Cesme Records ("Cesme," "we," "us," or "our"), based in Austin, Texas, USA, operates cesmerecords.com and all affiliated websites managed for artists and clientele on the Cesme roster (collectively, the "Sites"). This Shipping Policy constitutes a comprehensive, binding contract governing the purchase, processing, and delivery of physical products ordered through the Sites. It is deliberately exhaustive, inflexible, and designed to protect Cesme Records’ operational integrity. By placing an order, you unconditionally accept every provision herein. Non-acceptance prohibits you from engaging in any purchase transactions.

1. Order Processing and Validation

 

  • Processing Timeline: Orders are processed within 5-10 business days from the date of purchase confirmation, excluding weekends, Texas state holidays, federal holidays, and unanticipated disruptions such as inventory shortages, staff absences, technical failures, or supply chain interruptions. Processing begins only after payment verification, which may take an additional 2-5 business days depending on your financial institution.

  • Order Confirmation: Upon successful payment, an automated confirmation email will be dispatched to the address provided. Failure to receive this email does not negate the order’s validity; it is your responsibility to verify order status via your account dashboard on the Sites or by contacting legal@cesmerecords.com. Unverified orders remain binding.

  • Order Modifications: Modifications (e.g., address changes, item swaps) are permitted only within 12 hours of order placement, subject to written approval from Cesme Records via legal@cesmerecords.com. Beyond this window, no alterations are allowed under any circumstances.

  • Cancellations: Cancellations are accepted only within 24 hours of order placement, via a formal request to legal@cesmerecords.com. Requests must include order number, customer name, and a verifiable reason. After 24 hours, orders are locked, and cancellations are prohibited, regardless of shipping status or customer hardship.
     

2. Shipping Methods, Carriers, and Logistics
 

  • Carriers: Cesme Records contracts with third-party carriers, including but not limited to USPS, FedEx, UPS, DHL, and regional couriers, selected at our exclusive discretion based on cost, reliability, and availability. Customer requests for specific carriers will not be entertained.
     

  • Shipping Options: We offer tiered shipping methods, each with estimated (non-guaranteed) delivery windows:

    • Standard: 7-14 business days, suitable for non-urgent shipments.

    • Expedited: 3-7 business days, subject to carrier capacity.

    • Overnight: 1-2 business days, available only in select regions and for orders placed before 12:00 PM CST.
       

  • International Shipping: Offered to a limited list of countries, determined solely by Cesme Records and subject to change without notice. Customers bear full responsibility for customs clearance, import duties, taxes, VAT, and any additional levies imposed by their jurisdiction.

  • Tracking: Tracking numbers are provided for most shipments via email or account dashboard. Absence of tracking does not constitute a breach of this policy, as it is a courtesy, not an obligation.
     

3. Shipping Costs and Fee Structure
 

  • Base Rates: Calculated at checkout based on package weight, dimensions, destination postal code, and selected shipping method. Rates are fixed, non-negotiable, and subject to periodic adjustment without prior notice.

  • Surcharges: Additional fees may apply for oversized items, rural deliveries, fuel costs, or carrier-imposed penalties. These are assessed at Cesme Records’ discretion and added post-checkout if applicable.

  • International Fees: Customers are liable for all customs duties, taxes, brokerage fees, and handling charges, payable directly to the carrier or government authority. Cesme Records will not estimate, disclose, or reimburse these costs.

  • Payment Terms: Shipping fees must be paid in full at the time of order placement. Partial payments or deferred billing are not accepted.
     

4. Delivery Terms and Conditions
 

  • Delivery Estimates: All delivery timelines are approximations and subject to delays caused by carrier inefficiencies, weather events, customs processing, holidays, or force majeure incidents (e.g., natural disasters, pandemics, labor strikes). Cesme Records is not liable for late deliveries under any circumstances.

  • Address Verification: You must provide a complete, accurate, and deliverable shipping address, including street number, city, state/province, postal code, and country. Cesme Records is not responsible for delays, losses, or returns resulting from errors, omissions, or undeliverable addresses.

  • Signature Requirements: Orders valued at $200 USD or higher require a signature upon delivery, verified by an adult (18+). Refusal to sign will result in the package being returned to Cesme Records, with all re-shipping costs borne by you.

  • Delivery Attempts: Carriers will attempt delivery up to three (3) times, after which the package may be returned to Cesme Records or held at a local facility. Retrieval or re-delivery fees are your responsibility.

  • Failed Delivery: If a package is returned due to your absence, refusal, or address issues, you must cover return shipping costs plus a $25 USD handling fee to initiate re-shipment.
     

5. Lost, Damaged, or Defective Shipments
 

  • Lost Shipments: A shipment is deemed lost only after 30 business days (domestic) or 60 business days (international) from the shipping date, as confirmed by carrier tracking. Claims must be filed via legal@cesmerecords.com with order details and proof of non-delivery. Investigations may take up to 45 additional days.

  • Damaged Shipments: Report damage within 48 hours of delivery via legal@cesmerecords.com, including order number, detailed description, and high-resolution photos of the damage and packaging. Late claims are automatically denied.

  • Defective Items: Defects must be reported within 7 days of delivery, with evidence of the issue. Used or altered items are ineligible for remedy.

  • Remedy Process: At our sole discretion, we may offer a replacement, partial refund, or store credit (excluding shipping costs). Returned items must be in original condition, with all packaging intact, shipped at your expense unless otherwise authorized.
     

6. Returns, Refunds, and Exchanges
 

  • Return Eligibility: Returns are permitted only for defective or incorrect items, within 14 days of delivery, subject to pre-approval via legal@cesmerecords.com. Non-defective returns (e.g., buyer’s remorse) are not accepted.

  • Refund Process: Refunds, if approved, are processed within 30-45 business days of return receipt, credited to the original payment method, excluding all shipping fees. Partial refunds may be issued for minor defects.

  • Exchanges: Exchanges are offered only if replacement stock is available, at Cesme Records’ discretion. Additional shipping costs apply.
     

7. Restrictions and Prohibitions

  • Prohibited Items: We reserve the right to refuse shipment of hazardous materials, perishables, illegal goods, or items exceeding size/weight limits (e.g., over 50 lbs or 60 inches in any dimension).

  • Geographic Restrictions: Shipping may be denied to certain regions, countries, or addresses (e.g., PO boxes, military bases) without explanation or recourse.
     

8. Policy Amendments and Notices

Cesme Records may revise this Shipping Policy at any time, effective upon posting to the Sites. No individual notifications will be provided, and continued purchases signify acceptance of all changes.

Shipping inquiries or disputes must be directed to legal@cesmerecords.com, with detailed documentation. Responses are issued within 30-90 business days, at our discretion.

10. Governing Law

This Shipping Policy is governed by the laws of the State of Texas, with exclusive jurisdiction in the courts of Austin, Texas, USA. You waive any right to pursue claims elsewhere.
